Protect yourself when dropping of inflatables for use by customers without the supervision of the owner operators.
Cutting Edge Creations, does not endorse companies dropping off inflatable bouncers, slides, obstacle courses, etc. to be operated by unqualified customers just to save a few dollars on rentals. But, if this is the way you operate your business… take a few steps to reduce potential liability in the event of an injury:
1. Create an Indemnification from liability for miss-use of the inflatable device, that must be signed by the customer, specifically stating that they have received the instructions, both a written copy and verbal instruction, as to the correct safe use of the inflatable device. Make sure this Indemnification states that the customer agrees to abide by the written manual guidelines and agrees to operate this device according to the written and verbal instructions they received. Make sure this Indemnification is signed before leaving the customer with your inflatable device.
2. Create an injury/ accident report packet. This packet can be a sealed packet that includes the following:
a) Sheet listing places for witness names and address information as well as a witness comment area for up to a dozen potential witnesses that may have seen exactly what transpired to cause the incident. Make sure to include contact info for each witness.
b) Include areas to write in weather conditions, be detailed as to moisture, temperature, wind, etc. Also include a time stamp area to indicate the time of day the incident occurred.
c) Buy a cheap 24 exposure disposable camera. Instruct the customer as to its use along with the completion of the injury report.
d) Include your emergency or after hour contact phone numbers.
e) Include a pen.
